Here's the Q & A that sounds like a loophole for the limited operation:

Is the cost of a communication and tracking system or the mine operator’s financial ability to purchase these systems taken into consideration by MSHA?
Yes. MSHA will consider whether the systems are economically feasible on a case-by-case basis.

On surface (no pun), this seems like an exemption could be granted (no pun)... :notsure:

Each mine owner will have to present their own case, but it looks promising. If all mine owners just use the same lawyer to do it for them, shouldn't cost too much to possibly get a huge return.

Most of the Independent miners use the same lawyer already

MSHA is a Goverment controlled agency. If they do not what coal they will make it so tuff for the Anthracite suface mining companies with Rules Regulations and Huge Citation & fines They can Put them all out of business .
Not that I see that Happening yet with Anthracite suface mining Companies.
But It ishappening with the Anthracite Underground Mines .
So it can Happend with the Anthracite Suface mines if they want it to .

UAE is still at 145 a ton. They have a two ton limit, but they had a 1 ton limit over the winter, and talked to some people who were able to get two ton then. Depending on how you sweet talk the coal nazi lady in the office. ;)

Well June 15th is here and gone, everybody is still running. There has been some very positive discusion between MSHA and the Independant Miners so everybody keep your fingers crossed if everything goes well they will come to an agrement that both sides will be happy with. Well as happy as can be expected anyway!

That is because they were granted a extension Two and a half weeks ago like you mentioned in the show on the 4th
MSHA is going to pick one of the Anthracite undeground mines to test the system to see if it even works in a Anthracite mine. Then they will decide if everyone has to use it but even if it does work in one that does not mean it will work in all
of them . This is far from being over it is just the beginning of a long hard fight for the Independed mine Owner's & Operators. The first Tunnel Radio of America was installed in 1988 in Alaska it was the first reliable wireless VHF radio
system used in a underground mine / Bituminous mine . In last 20 years they have installed the Tunnel Radio System
in 20 states and several foreign countries all have been Bituminous mines No Anthracite mines . They Have several

models that are MSHA approved TR-500 UHF & TR-155 VHF UltraComm Communications system to the MSHA approved
MineAx BirdDog tracking and tagging system . In 2007 Tunnel Radio of America . received MSHA approval for there
UltraComm system. This system utilizes Distributed Antenna Networks (DAS) To supply the mine with two-way radio
communication system . They tested in mines both hard rock and coal . The MineAx BirdDog tracking system has
received Both MSHA & West Virginia Safety Approvals . Tunnal Radio become both Miner act 2006 and WV compliant .
Utilizing Ultracomm system with the BirdDog tracking System. The mine will have complete communication and tracking
system . It all sounds good Lets see if it works in a Underground Anthracite mine First. Before MSHA makes the Owner's
and Operators buy them for their mines . The system has been around since 1988 and The miner Act was pasted in 2006 and know one tested in a Anthracite Underground mine yet goes to show what type of People are Running MSHA / Gov.
