Sotomayer/Firefighter ruling Reversed

Now for some good news for a change:

WASHINGTON - The Supreme Court ruled Monday that white firefighters in New Haven, Conn., were unfairly denied promotions because of their race, reversing a decision that high court nominee Sonia Sotomayor endorsed as an appeals court judge.

About time something like this happened.

I read several of the first few pages of the finding. Key issue discussed was when the test was being formulated by a contractor, the city had concerns about question bias concerning ethicity, etc. The city's concerns were acommodated by the test contractor to the city's liking prior to employee testing. Then comes the test and people of certain ethicity fail. City then nulls results since city afraid of law suits. Supreme Court say, nay, nay. Key issue here is that city had pre-existing knowledge of issue and accomodated it to their satisfaction prior to test commencement.

Only one justice was dissenting (Ginsberg).

Now come the lawsuits for back pay, etc, I bet New Haven will need to find another insurer.
This is another of many NH flubs including ID cards for illegals.

The guys that passed that test are getting a lot of back pay out of this.

Actually it was a five to four split.

When Sotomayor made the New Haven decision there were two other judges (both conservative) and it was a unanimous decision following already set precedence. The court just affirmed already set law.

The SOCTUS made new law with it's decision basically setting the civil rights movement back about fifty years.

Actually both her and the SCOTUS position has the same line with different results. Keep race out of it.

Race was the point of the court case. As in reverse discrimination. Not enough minorities were able to pass the test so the city of New Haven decided to throw out the results so they wouldn't get sued by the ACLU for having a test that was biased against minorities.

Not having seen the actual test, I couldn't say whether the test was biased or not. I'm not making any judgment as to the validity of the court case either.

I know two of these guys personally, the test itself was free of race. New Haven's decision to toss the testing was based on race and that is what was overturned.
