I read several of the first few pages of the finding. Key issue discussed was when the test was being formulated by a contractor, the city had concerns about question bias concerning ethicity, etc. The city's concerns were acommodated by the test contractor to the city's liking prior to employee testing. Then comes the test and people of certain ethicity fail. City then nulls results since city afraid of law suits. Supreme Court say, nay, nay. Key issue here is that city had pre-existing knowledge of issue and accomodated it to their satisfaction prior to test commencement.

Now come the lawsuits for back pay, etc, I bet New Haven will need to find another insurer.
