Federal conspiracy charges require two or more parties planning a crime and an overt step in the furtherance of that crime. I'm not sure what other crime these tapes might show.
The problem is two fold:
1. There was no overt step taken as far as I know. No one took any steps to open a brothel. No one tried to bring underage girls across borders. No one filled out fraudulent tax forms. She isn't a hooker (as far as I know) and he's not a pimp.
2. James and Hannah are as equally guilty of conspiracy as the Acorn employees are. You can't charge Acorn with conspiracy without charging the film makers. If they are not charged there is no 2nd party, if there is no 2nd party, by definition it is impossible to have a conspiracy.
I think the only real effect here might be to force acorn to have to open up their books (which as a non profit they already have to do anyways).
