There is no provision in the community's rules expressly forbidding flagpoles,

Therefore he has to take it to court, and pay mega$ in legal fees just to keep it?
He probably has a good idea where he really wants to put that pole :mad:

I lived in Florida for two and a half years. the Gestapo of home owners associations is incredible. It will be a cold day in hell before I will live in a homeowners association. they will REPOSSESS your home for not painting your chimney even though you are sick in the hospital and cannot pay attention to your house at the moment. I have seen it with my own eyes. If you think I am bull shitting you just PM me and I will set you strait.

I owned a home over 20 yrs in fla and the cities "code enforcement" division told me when to cut grass what color to paint house how many cars to park or boats or when to roof ect.

needless to say i told them a few things many times!! :lol: :lol:

they loved the purple house paint for a month or so....... :P

usually home owner associations get a bit choked as it goes into court

good thing is in fla no one cept po-po can step foot on your property if you display no trespass sign and its leagal to be cocked and locked on your property for any loudmouths trying to "threaten" you. they usually give up and go bother old ladies down the street after they realize thier $8.50/hr job dont provide bullet proof vests... ;)

A veteran can'nt fly the flag. I would think that was one of the rights that he helped defend for us in three wars. I hope the VFW and others help this man set everyone straight. Thats even worse than someone not being able to hang out the laundry. Which is causing a big stink somewhere in PA. This country really needs a gut check! :(

+1 for never living in a gated community. Local building/zoning codes are bad enough, never understood voluntarily allowing someone else to dictate what you can do with your private property.

It comes down to what was in the contract he signed. if "no freestanding flag poles" was in it then tough cookies.

It's probably not specifically banned to erect flagpoles and the like but I wouldn't be surprised if there weren't some weasel words to the effect that all decisions rendered by the homeowners ASSociation are binding.

That's why I chose to live in the sticks. I can't see any of my neighbors and they can't see me. Perfect :up:

I rented in a HOA community once and, when my brother was looking at a house in one, I advised him to, as Elmer Fudd used to say, "Be vewwy, vewwy careful."

Upside: neighbors can't have cars up on blocks, unmowed lawns, flamingoes or other weird decorations that you might find unsightly on their property.

Downside: you give up rights to do certain things too, and oblige yourself to do others.

Sure, it's pretty dumb to apply a rule against free-standing stuff on your lawn to a flagpole for a veteran. Or not to have made an exception for it in the first place. But, if it violates the rule and they don't pursue it, the next guy has a defense when they try to bite him in the fanny about something else.

My prediction is that they'll either change the rule or the state legislature will change it for them. Or maybe they'll decide on a central flagpole, and this guy can do the honors.

Now that I think of it, I seem to remember that our boy Donald Trump pissed a bunch of his homies on Jupiter Island off by putting up a GIANT flagpole for Old Glory a couple years back. Don't know how it turned out but I guarantee that a lot of lawyers made plenty if it got pushed very far.
