Wait, how is the guy still voting? He is no longer an elected Senator for MA, his term ended the night of the election because it was a special election. Normally he could remain seated until MA certified the election and the Senate seated the new Senator elect, but in the case of a special election MA law is pretty clear that the temporary seat holder is out the day after the election. At least that is the way the analysis of this issue read in the days leading up to the election. Perhaps it was all smoke to give Pelosi and Reid nervous fits about trying to ram through health care before Brown was seated. Even if it was, I'm surprised there wasn't more of an effort within the Republican caucus to make hay out of Reid's reneging on getting Brown seated without delay.
