The Castle Doctrine comes to PA

House bill 40, better known as the extension to the Castle Doctrine, is headed to Tom Corbett's desk.

" It`s called the castle doctrine which is a little bit of a misnomer because it implies that you can defend yourself in your home. You already have that right. What this does is it expands the right to defend yourself that you have a legal right to. Whether that be in your car, at the mall, walking your dog , if someone attacks you you have the right to defend yourself," says Senator Richard Alloway, R-33rd District



I don't recall anyone ever being prosecuted for shooting anyone in their home but you had a "duty to retreat" before using deadly force. The most important part about this legislation is it removes the possibility of someone questioning whether it's justified during the crime when thy really need to be concentrating on more important things like saving their life.

Hopefully it will be signed & I won`t need to bury a body in the swamp like I figured on. Even if now you could probably just throw one in a pit of fracking fluid & let that destroy the evidence. Around these parts no one pays much attention to gun fire other than to ask if you need help, which includes more guns or the use of a backhoe. Gives them snappers something to chew on as well, swamps ain`t all bad.

Believe it or not Richard a friend of mine on the other side of the lake in Espyville has a cannon that we made down in the boiler shop at work. He fires it off from time to time (holidays) with just a powder charge & I can hear it about 5 or 6 miles away as the crow flies. He does have some large ball bearings just incase.

Typically the biggest benefit of such laws is not the protection from criminal, but the for sure to follow civil suit. VA can never seem to get this all the way thru.

A person that is prepared to forcably enter another home with bad intentions is really evil. Perhaps even worse than Bernanke. I keep three things on hand an AK47 & handcuffs - make them sit down and handcuff them to a chair and make them listen to the third weapon - the advantages of an AFUE gas condensing furnace over and over. The screaming can be horrible so earmuffs are good.

From what I know the Governor has said he will sign the bill. I think it's long overdue.

This legislation is commonly referred to as the “Castle Doctrine.” It expands and further defines an individual’s right to use deadly force inside the individual’s dwelling, residence, or occupied vehicle and outside an individual’s dwelling, residence, or occupied vehicle. In short, this legislation eliminates an individual’s duty to retreat before using deadly force if the person is in a place the person has a right to be and believes an attacker will use deadly force to kill, seriously injure, kidnap, or rape themselves or another.
The Crimes Code is amended by House Bill 40 concerning the offense of receiving stolen property if the property is a firearm. The grading for this offense increases to a second degree felony. Also, receiving a stolen firearm when the offender is involved in the business of buying and selling stolen property is increased from a second to a first degree felony.
Finally, this legislation provides specific protection against civil liability when force is lawfully used in self-defense or in the defense of others

I won't hold my breath for this to pass in MA. In MA your supposed to be a pansy & run the other way while some criminal rapes your wife. I'll be damned if I, or any other American sits idly by & lets that happen. :mad: But I guess that's how they do things in metro Boston .... Sit down for tea with rapists, gang bangers, & terrorists ... :roll:

This should be the supreme law of the land. Why it isn't, I'll never understand .. but at least MOST states "get it".

MA laws on firearms are the most confusing & moronic in all the world. Basically what it comes down to here is ... who do you know? If you know the right people, you'll be ok. If not, you'll be cannon fodder for the left wing news & papers.

I've got to go sharpen my shovel now .....

This 'group' CeaseFirePa, they really crack me up!!! While I understand the logic behind getting the guns from the criminals hands, they must be crazy to think that this is even the least bit possible... Guns will NEVER be taken from the criminals hands, they will always have an outlet to purchase, steal, or otherwise have guns and weapons of sorts... So, the way I see it is if a law abiding person is given the right by law to fire upon a criminal without repercussion per se, and that criminal is injured, mamed or killed as a result, then there you have it, one less criminal on the streets and in lots of cases one less gun from the hands of one too... Now that's gun control done right... One less gun from the hands of someone that shouldn't have one to begin with that otherwise without this bill would still be commiting crimes or killing people with it... Just my take on it...

Mr. Corbett, do you need a pen??? I've got plenty right here...

And I have a backhoe that would be available to any forum member. All that is needed is some night vision goggles to operate in the dark. :whistle:

Your right its way past time, the next thing they have to do is give County Police arrest powers, hard to believe that Pa. counties have police forces that are nothing more than armed doormen. Sounds like its a fight with the state police to see who has the biggest nightstick, meanwhile all of Crawford County only has one state cop on duty overnight. We really need the Castle Doctrine for those in the county that don`t have their own room to bury the evidence.
