....and if it is an inoperable prop we can now discuss his journalistic integrity for not noting it was prop because he couldn't legally posses the real thing.

NBC and Gregory lose no what the outcome of this is. :)

Looks like after contacting the DC police they got some bad advice, if the ATF and "DC officers" don't know what the law is how is your average citizen supposed to know what is?

http://abcnews.go.com/blogs/politics/20 ... d-gun-law/

Gwendolyn Crump, director of the Office of Communications for the Washington Metropolitan Police Department, told ABC News, “NBC contacted MPD inquiring if they could utilize a high capacity magazine for their segment. NBC was informed that possession of a high capacity magazine is not permissible and their request was denied. This matter is currently being investigated.”

But ABC News has learned from an official at the Bureau of Alcohol, Tobacco, Firearms, and Explosives that NBC had reached out to the federal agency on Friday for advice before displaying the weaponry.

According to the ATF official, the agency noted that ATF doesn’t enforce D.C. gun laws, but agreed to put the question to a couple of Washington police officers who’ve worked with the agency in the past.

The D.C. officers advised the ATF spokesman that Gregory could display the magazine, provided it was empty, the source said.

That turned out to be bad advice, as conservative media and gun rights activists were first to note. The ATF official describes this as a “misunderstanding,” and says he hopes DC police will not bring charges

Welcome to Massachusetts, Richard - this is what we deal with here on a daily basis. Even LAWYERS with 30 years experience have to do their homework before presenting any case regarding our convoluted gun laws.

If you were to put all of MA gun laws into one book, I'd estimate it to be in the neighborhood of 20,000 pages, and 3 feet tall. No cop in the state knows all the laws. I don't think even our elected officials know all the laws!

If they want to put these stupid assed laws in place, then they'd better damn well enforce them!!! Liberals love to cherry-pick who gets to abide by what laws. If it were Bill O'Reilly, every news organization on the planet, along with all the moonbat anti-gun wackjob organizations would be calling for his head on a platter. Gregory should be made an example of, because WE would if in his shoes!

START ENFORCING YOUR GOD DAMNED LAWS, D.C.!!

Ignorance is not a excuse for breaking the law. He should be charged and fight the moronic laws that make owning such a item illegal. The other question is where did he acquire it and was it transported in from another state? That would be another law broken. You never know a criminal may get a hold of that magazine now that it was transported illegally on state highways.

Sheesh! You can read the Second Amendment so carefully, but not the First?

Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof;
or abridging the freedom of speech, or of the press; :!: :!: :!:
or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.

So does the right to bear arms allow me to shoot someone?

I don't see that in the text of the amendment. But many places have laws saying you may, and many courts have affirmed that you may, within reason.

What I'm asking is can I just ignore the law and shoot anyone with my gun because my right to bear arms has been secured by the second amendment?

I don't see anything in the text of the first amendment that puts the press above the law either.

Having said that who's the press? Am I the press? If I rename this site NEPA Press and declare myself reporter am I now above the law?

Sam it's actually pretty big problem because anybody can be the "Press" but people like that are often disregarded and don't get the same accommodations afforded the traditional press regardless of how well written their articles may be. If this were you or me and waving around this magazine from our Washington headquarters on youtube the DC police are knocking at our doors.

Richard all I tried to point out is that the same people that are gripping about "new" gun regs. that they know absolutely nothing about since they haven't even started (as far as I know) are now complaining about someone not being jailed for a stupid gun law that they would normally all be against. It's not the law so much as how or why.
As for the free lance reporters, just thought it would be a heck of a pick up line for some young single folks, didn't mean nothing by it. :(

Sam the bottom line is if I'm going to jail for this he has too. Not that it could or should make a difference but they can't even use the excuse of ignorance because they were told it was illegal to posses that magazine in DC. If someone in law enforcement tells you something is illegal are you going to go waving it on national TV?

It's a dumb law and hopefully he gets arrested and made an example of how easily it is to break these laws in different jurisdictions.

He would be a fine example of how moronic those laws can be.

I don't disagree that a law should be a law for anybody, what I implied was that many here have said that they wouldn't obey certain gun laws should they be enacted & that they don't agree now with most of our laws yet when it comes down to someone or thing that they don't like then they want that law. Heck I was nearly the only one that ever complained about insider trading being OK for Congress, technically I guess if you make a loop hole for yourself or others then that's OK even if then a law is only a law for some. It should not be both ways IMHO.
