I live in Central NY area. I never called a code guy since getting Certificate of Occupancy 3 years ago. Have built steps outside and put in coal boiler. They can just have a nice day and keep moving. "Nothing to see here!"

They can only enforce written regulations. They can have regulations above and beyond state code but must be adopted by the governing body and in writing.

The code enforcement officer is the local authority have jurisdiction. If he rejects something, he must give you written notice and cite the code being violated. He can however interpert the code.

There is no requirement in NYS codes that a solid fuel appliance be UL listed. This would have to be a local code.
It does require the product to be listed and labeled by an independant testing agency for the use of which it was intended. It only requires that a record be kept of this testing.
Keystoker doe label their units. As far has ever having them tested, ask them.
The only documentation that should be required is that the appliance is listed for the use intended. Example - you cannot burn wood pellets in it as it is not listed for it but you can burn rice coal because it is.

ASME construction is not required for residential buildings under 6 living units (apartments or townhouses). Keystoker boilers are NOT ASME constructed. This should not an issue.

You should maintain the clearances around the unit as required in Code rule 4 (2 feet back and sides, 4 feet in front). I consider the hopper the front but you may want more than 2 feet on the ash bin side.

Carbon monoxide detectors are required in the Property Maintenance Code and are a must with coal heat.

Requirements for chimney's apply. Solid fuel appliances must have their own chimney

Note: He can "red tag" the appliance and prohibit operation if he feels it is not installed per code, but he must state the reason. You can argue with him but it is better to discuss it pleasantly. It will be difficult to go over his head legally without a lawyer.

PS I agree a KC-10 is a big unit. You must have a huge heat load.

This is EXACTLY the order to do this in!!! after install, if the building inspector will not sign off on the permit you can then go to the town manager to ask his help in getting the inspector to your home (either way... this is the order by which to move forward... apply for permit, pay your fee, have it installed correctly, when done call building dept and email them as well for records to let them know its done... its then incumbant on them to come out.

If they continue to pursue the issue... I would find the highest ranking person in the office and explain that "their ignorance" should not cause me any more issues or a law suit will be coming their way.

Local code enforcement officials always feel the need to justify their job. I been dealing with them for what feels like forever.

This is also why when they nationalized the 2003 IRC everyone went to a third party inspector. It relieved the Twp of all liability.

I appreciate all your replies. We really learned our lesson on this one. Otsego county, cooperstown. We do have a heavy heat load, 4,000 sq ft + garage and I will want to heat a workshop as well. If he is going to ignore us, then we are going to ignore him. We have no use for him. Just another bureaucrat, supported by our tax dollars. This wouldn't get sorted out until next spring anyway, so we are forging ahead, so we can stay warm this winter. He's not coming into our house without a warrant and armed law enforcement anyway, so the point is moot. If he asks we say we just changed our minds and are sticking with the oil boiler and we withdraw our permit application. Don't want to pursue lawsuits, that takes years and costs lots of $$$$. just want to live our lives and stay warm.

Thats what I was thinking, but he's dammed if he does and dammed if he does not.. It would be opening another can of worms. Thing of it is , if his house burned down the insurance company could tell him to take a hike, so the question is ,, is it worth the risk, I've been down this road before, I'll take the high road....

ETA.. what will this mean when he sells the house, some day...

As far as insurance--I have State Farm--I hooked up the stove in accordance with State & manufacturer guidelines & they came & looked & things were fine--problem is--or so I've heard from others--this to is a crap shoot also-- We fortunately have an outstanding Code guy--retired State Trooper that understands who & where we are out here in Freetown.
