Restrictive California Concealed Carry Law Struck Down!

This could actually have wide ranging consequences, it could be more important than the DC ruling since this addresses possession of a weapon outside the home. .

A divided federal appeals court on Thursday struck down California concealed-weapons rules, saying they violate the Second Amendment right to bear arms.

The 2-1 ruling of a three-judge panel of the 9th U.S. Circuit Court of Appeals said California counties were wrong to require law-abiding applicants to show "good cause" beyond self-defense to receive a concealed-weapons permit.

California prohibits people from carrying handguns in public without a concealed-weapons permit. State law requires applicants to show good moral character, have good cause and take a training course. It's generally up to the state's sheriffs and police chiefs to issue the permits, and the vast majority require an applicant to demonstrate a real danger or other reasons beyond simple self-defense to receive a permit. The 9th Circuit on Thursday said that requirement violates the 2nd Amendment.



Next step will proabaly be SCOTUS.

Scotus already ruled with Heller and DC .I doubt if they will even take it.

I am a pessimist. I think the courts are appeasing the masses with pro gun rulings because they have realized that the people were reacting with alarm and arming themselves to fight with all the other things that are being done. To further try to disarm the people would have been a clear sign that our gov. had a plan we might not go along with. The weapons are already out there, what few more are acquired are of no consequence to whatever plan is being moved forward. Watch what the left hand is doing while the right hand is being shown.

This is the most pro-2nd ruling as of late ... In NY,MD,NJ..hell, any east coast they are still ruling like Heller did not exist for the most part.

No many pro-2nd rulings really, mostly bad ones.

Dave this is significantly different, the California law didn't ban ownership. Open carry is illegal in California and this law allowed for denying a permit unless you had a reason to carry e.g. victim of domestic violence. You needed a reason to get the permit. Without a permit the gun couldn't leave the house. Basically what the court has said is they can't ban possession of a firearm outside the home and none of these cases have addressed that yet. This is most certainly going to SCOTUS. Assuming SCOTUS agrees every state will either have to allow open carry or be "shall issue".
